These terms and conditions shall remain in effect indefinitely and shall apply to all services provided through the TuriTop website. The official versions of this content are those in English and Spanish; automatic translations into other languages are not binding.
This document supplements the data processing agreement to be entered into with all data controllers using the platform, the legal notice, and any other legal content related to the provision of TuriTop’s services.
1. About the TuriTop Online Platform
TuriTop is a technology company dedicated to the development and marketing of a Software as a Service (SaaS) suite designed for businesses and professionals. These tools facilitate booking management, online payment processing, integration with resale portals, and a wide range of other features that automate tasks and improve the service provided to the end customer.
The services offered by the platform are those listed on the platform itself, and any new service offered by TuriTop will be subject to these Terms and Conditions.
The contractual relationship involves access to and use of the TuriTop platform, under the contracted plan, in exchange for a specific price that is publicly displayed on the website in the pricing section, or as specified in specific agreements.
1.1. Purpose of the Contract
The purpose of these Terms and Conditions is to govern the contractual relationship established between TuriTop and the CUSTOMER at the moment the latter indicates acceptance of these Terms and Conditions by checking the appropriate box during the online registration or sign-up process.
In general, the contractual relationship involves access to and use of the TuriTop platform, under the plan selected in exchange for a specific price that is publicly displayed on the website in the pricing section.
1.2. Identity of the Contracting Parties
On the one hand, TuriTop S.L. is the owner of the platform and provider of the services offered through www.turitop.com, with its registered office at Avenida del Atlántico, 9, Residencial Winter Gardens, Block 3, Offices, Tax ID B-76534759, and with a customer/user service phone number of (+34) 922 394 632.
And second, the CLIENT, who registers on the platform in their own name, either as a self-employed professional or as a representative of a legal entity.
The account holder is the person who accepts these terms and conditions, acknowledges having sufficient legal capacity to bind themselves as a self-employed professional or the legal entity they represent, and guarantees the accuracy of the information provided to ensure the smooth conduct of the relationship with TuriTop. This user is also the one who may create employee accounts or, in some cases, supplier accounts.
2. Registration and Onboarding Process
2.1. Registration on the Platform
The onboarding process begins with registration on the platform, which can be completed by the client or the TuriTop team using the Demo account. In all cases, the client will have access to all information regarding the Terms and Conditions, Data Processing Agreement, Privacy Policy, and pricing. The official versions are always the Spanish and English versions.
2.1.1. Registration via a trial account (Trial) by the customer
Once the customer creates their own account on the platform, they can enjoy full access to it for a maximum free trial period of 14 days. Once this period ends, the customer will be able to choose the plan that best suits their needs and proceed with the contract. See more information about plans at our pricing page
2.1.2. Sign-up via a Demo Account Created by TuriTop
Initial Contact
In this case, the registration process—and therefore the sign-up process—begins with an initial online interaction that allows the customer to learn about TuriTop and its platform, as well as the available plans. To initiate this first contact, the customer will select the “schedule a call” option, choosing a date and time for the call, and providing the personal information of the prospective client-owner or their representative.
Creating a Demo Account
Following the meeting and with the customer’s approval, the TuriTop team will create a demo account to present the recommended service options to the customer and show them how to use the platform so they can make the most of their trial period and manage their account from the very beginning. Once the client agrees to sign up for the service, they can proceed with the sign-up process by entering payment details and other supplementary information.
2.2 Completing the Sign-Up
In both cases, the entire sign-up process and acceptance of the offer are completed online. During the process, the customer must accept the offer and pay their first installment. The user completing this process must have full authority to represent the customer and the legal capacity to enter into this agreement.
3. Pricing, Billing, and Payment
Use of the TuriTop platform generally entails a fee in accordance with the pricing plans available at any given time. The price to be paid is the one published at the time of signing up, except in specific situations such as:
- Trial period: This is a 14-day period that allows the customer to use the platform free of charge for up to 14 days. Once this period ends, the customer may sign up for a plan or will no longer have access to the platform.
- Specific agreements formalized with major OTAs and other partners outside the platform.
- Customers of the Legacy platform with prior agreements and specific rates.
- Hotel customers and supplier users of TuriTop customers. These are two types of accounts with restricted services, created specifically to interact with TuriTop customers on the Marketplace.
In all cases, these Terms and Conditions shall apply, notwithstanding that the sections related to billing and collection may not apply to them in whole or in part.
3.1. Prices
TuriTop keeps the prices of its products, plans, and services up to date. The prices applicable to each product are those published on the website, /turitop-prices/, and are expressed in euros; applicable taxes will be added to these prices.
3.1.1. Specific Offers
TuriTop may apply price exceptions, discounts, and other special payment or discount terms during promotional or loyalty campaigns. In these cases, the benefit applied and its duration will always be clearly identified. Any discount or payment exception will be valid only for the period specified during the application process; and once that period ends, the next invoice will reflect the standard service price.
3.1.2 Party Responsible for Payment and Data Updates
The account through which payments are managed is that of the account owner—the same user who accepts these terms and conditions. Please keep the contact information and user profiles for your organization up to date to avoid administrative issues.
Please remember that the user accounts created by the owner, regardless of their type, are the owner’s property and operate under the owner’s sole responsibility.
3.2. Change of Ownership for Vendor Accounts
If a vendor-type user wishes to claim ownership of their account and thereby separate from the original owner’s account, they may contact sales@turitop.com to initiate the corresponding process and thereby become a TuriTop Customer who enjoys all the privileges of a paid subscription.
3.3. Price Changes or Service Modifications
TuriTop will notify the Customer of any changes affecting existing financial agreements, with sixty (60) days’ advance notice prior to the effective date of the change. This notification will be sent via email to the administrator’s email address. If the customer does not express their disagreement with the communicated changes within the specified timeframe and in the appropriate manner, they will be deemed to have accepted them.
The expiration of the term for using legacy plans, the end of a payment grace period, or the termination of a discount period or a special price resulting from a specific offer shall not be considered a price change.
3.4. Billing and Payment Methods
3.4.1 Acceptance and Submission of Payment Information
Once the sign-up process is complete, the Customer must access the billing dashboard to enter the credit card information that will be used to pay for subscriptions going forward. The Customer must maintain a valid and active payment method at all times. In the event of a payment issue due to the expiration or invalidity of the payment method, the Customer must resolve the issue as soon as possible.
3.4.2 Billing Cycle
The billing cycle corresponds to a calendar month, from the first (1st) day to the last day of the corresponding month. On the first (1st) day of each month, TuriTop will issue the invoice for the current month, which will itemize the amounts corresponding to each of the contracted services and the subscription for the current month, any discounts or promotions that may have been applied, transaction fees for the previous month, and all applicable taxes. In the event of an issue with the billing or its associated documentation, the customer must contact TuriTop as soon as possible to resolve it.
The customer may check the status of their billing and the contracted services at any time through the platform’s control panel.
TuriTop’s website features a payment gateway through which the customer can pay using either a debit or credit card. TuriTop offers the highest standards of confidentiality and security for authenticating online service purchases. If the customer needs to request payment through other means, they may submit their request to sales@turitop.com, and it will be reviewed by the TuriTop team.
3.4.3 Billing for Subscription Changes
The customer may make subscription changes between the 2nd and the last day of each month. If the subscription change results in a price difference in TuriTop’s favor, the amount will be charged immediately, as subscriptions are paid in advance; if the credit balance is in the customer’s favor, it will be calculated in the settlement on the first (1st) day of the following month and offset on the next invoice.
3.4.4 Payment Issues and Non-Payments
However, the corresponding amount or outstanding balance may be invoiced and collected immediately when:
- The Service is suspended or interrupted as provided for in these terms and conditions;
- The contract is terminated or rescinded.
The Customer must pay invoices upon their due date. Unpaid invoices will accrue late payment interest equal to the statutory interest rate; furthermore, TuriTop will charge the Customer an additional amount of fifteen (15€) euros as a result of the failure or inability to collect the unpaid invoice, as compensation for the damages that this situation has caused.
Non-payment of invoices due to disputes with third-party payment platforms will be analyzed on a case-by-case basis. If the dispute is ultimately deemed unfounded, it will be considered a non-payment of the invoice, and therefore the Customer, in addition to the invoice amount, must pay the 15€ to TuriTop to cover the payment platform’s fees to TuriTop.
TuriTop may assign the collection of unpaid invoices, in whole or in part, to collection agencies and/or assign the receivable, in whole or in part, to third parties; all in accordance with applicable regulations. In the event that such data is disclosed, the customer will be informed prior to the assignment.
4. Term of the Contract
The contract shall be effective from the moment the customer accepts the service offer, resulting in a subscription that shall remain in effect continuously from that moment onward.
The customer may cancel their subscription at any time; doing so will result in the suspension of subscription charges, without prejudice to the settlement of any applicable transaction fees due on the 1st of the following month.
The customer may not delete their account if they have outstanding balances. However, as long as they do not have an active subscription period, they will not be able to use the platform.
5. Provision of Services: Continuity, Interruptions, and Suspensions
TuriTop reserves the right to modify the commercial offer presented on the Website (changes to products, plans, prices, promotions, and other commercial and/or service conditions), in its Policies, and in its Terms and Conditions.
Some of the Services offered by TuriTop are subject to additional specific terms. In such cases, the Customer must accept, without booking, those specific terms for the contracted service. In any case, the Customer will have access to these Specific Terms before the contract for the corresponding service takes effect.
TuriTop is committed to providing continuous availability of this service to the Customer. However, TuriTop reserves the right to cancel or suspend the service if the Customer violates these Terms and Conditions or the Specific Terms of their Contracted Plan. Service cancellations or interruptions may also occur if there is a legal requirement or obligation that warrants them.
Furthermore, TuriTop informs the Customer that the Service may be temporarily suspended or interrupted in the following cases:
- Delay in payment for the Service lasting more than one month, counting from the corresponding payment date.
- Non-payment for the Service.
- An issue regarding the Customer’s actual possession of the necessary authorizations or requirements for the proper performance of the activity they carry out, or the proper verification thereof.
- Interruptions to the Service may also occur due to force majeure or unforeseeable circumstances recognized as such by case law, which includes situations such as: natural disasters, war, a state of siege, public disturbances, transportation strikes, power outages, or any other exceptional measure adopted by administrative or governmental authorities.
- Any other breach by the Customer of the commitments set forth in these terms and conditions or in the Individual Contract to which they are party.
Service interruptions or suspensions caused by the Customer’s failure to pay will remain in effect until the outstanding amounts are paid. Any costs associated with reactivating the service will be borne by the Customer.
If the interruption or suspension is due to other causes, it may remain in effect until any incidents or causes that led to it are resolved and/or clarified. In such cases, neither TuriTop nor the Customer shall assume liability for any circumstances that may have arisen.
6. Customer Service
The Customer has several options for reporting outages, incidents, malfunctions, or, in general, issues related to the contracted services:
- Through the TuriTop control panel
- By sending an email to ayuda@turitop.com. The email customer support service will be available Monday through Sunday, except in cases of force majeure.
Additionally, TuriTop will offer telephone support to subscribed customers in accordance with the plan contracted by the Customer in each case; therefore, the Customer must always comply with the specific terms and conditions of the contract.
Business hours: 9:00 AM to 5:00 PM in San Miguel de Abona (Santa Cruz de Tenerife, Spain).
TuriTop has included machine translation tools to facilitate access in multiple languages for its customers and users; these translations are not reviewed by a human and are therefore not binding. If in doubt, please consult the official documents (English and Spanish versions) or contact the customer service team, which provides assistance in English and Spanish.
7. Acceptable Use, Rules of Use, and Service Deactivation or Blocking
The user agrees to make proper use of the platform, their private account, and, in general, the resources provided by TuriTop, in accordance with the Terms set forth in this section, as well as the law, morality, generally accepted standards of conduct, and public order.
The user agrees to use the platform provided by TuriTop solely for purposes related to their status as a user and undertakes not to engage in fraudulent uses or purposes that may be harmful to the rights and interests of third parties, nor to take any actions that may harm, render inoperable, overload, or degrade the services and features provided, and shall not, in any way, impede the normal use and enjoyment of the platform by other users.
Accordingly, to the fullest extent permitted by applicable law, TuriTop reserves the right to revoke the user’s access to the Platform, after first notifying the user via one of the contact methods provided by the user; to block or prevent the user from using and accessing the Platform in the future, including when TuriTop reasonably believes that:
- (a) the Customer’s use of the Platform violates these Terms and Conditions or applicable law.
- (b) the Customer is using the Platform fraudulently or improperly, or there are reasonable grounds to believe that suspicious or fraudulent activities may be taking place. Among others:
- Selling third-party services through one’s own account, acting as a front agency. This activity is available exclusively to Agencies registered as such in the system, and the products to be resold must be those of TuriTop Marketplace suppliers.
- Using the same account to sell services from two or more companies, regardless of whether they have the same owner. Each Tax ID must have its own TuriTop account.
- Use of the platform as a white-label service, removing the “powered by TuriTop” label when it appears in widgets and other platform tools.
- (c) TuriTop can no longer offer the Services for technical reasons or legitimate business reasons.
- (d) Users created by the client or account owner misuse the platform or act in violation of any of the three preceding points.
- (e) The client exhibits inappropriate, aggressive, or unseemly attitudes or behavior, or expresses disrespect toward TuriTop employees, either verbally or in writing.
8. Intellectual and Industrial Property
The platform that TuriTop makes available to the Client under these terms and conditions is the property of TuriTop, which holds title to it and also asserts the intellectual property rights of third-party owners of some of the technologies used on its platform; all content, whether owned by TuriTop or by third parties, is protected by national and international intellectual and industrial property laws, including, by way of example, but not limited to, its programming, editing, compilation, designs, logos, text, and/or graphics.
The Customer’s access to and use of the platform does not grant them any ownership rights thereto, nor does it imply, either directly or indirectly, any transfer in their favor of intellectual property rights, which are expressly reserved to their rightful owners.
By virtue of the foregoing, the Customer acknowledges and agrees to respect all intellectual and industrial property rights held by TuriTop and its suppliers regarding its platform and all elements, goods, or services that comprise it.
In this regard, the Customer acknowledges their obligation to safeguard TuriTop’s intellectual and industrial property rights, and agrees not to remove, obscure, or conceal in any way TuriTop’s logos, trademarks, or other components of its industrial property. In situations where the Customer fails to honor this commitment and results in an infringement TuriTop’s rights, the provisions of Section 7.b. of these Terms and Conditions shall apply.
The Customer may not use the information contained on this platform, nor its design or graphic content, without the authorization of TuriTop or, where applicable, the holders of any intellectual and industrial property rights pertaining thereto. Failure to comply would constitute a violation of intellectual and industrial property rights.
The user is not permitted to reproduce, in whole or in part, of the website’s content, nor may they use TuriTop’s trade name, trademark, image, or logo without prior authorization.
In the event of a violation by the Customer of this clause, in whole or in part, the owner of such intellectual and industrial property rights—whether TuriTop, or a third party unrelated to TuriTop, may take the appropriate legal action to defend its legitimate interests and rights, including claiming compensation for all damages incurred directly or indirectly by the respective owner of the affected rights, including all expenses incurred by the owner as a result of the aforementioned, including, but not limited to, all legal representation and/or attorney fees, defense costs, costs associated with the proceedings and/or court costs, expert witness fees, or any other applicable expenses.
9. Liability and Limitations of the Service
TuriTop shall not assume any guarantees or liabilities beyond those expressly provided for in these terms and conditions, in the specific terms, or in the applicable regulations.
TuriTop shall not be liable, under any circumstances, for cases of force majeure or unforeseeable events, nor will it be liable for the failure or improper operation and/or provision of services provided or offered by third parties unrelated to TuriTop—even within the framework of the Service itself—and hereby excludes all legal liability in this regard to the fullest extent permitted by Spanish law.
In the event that TuriTop needs to suspend the service for reasons such as maintenance or the addition of new features to the platform, it will notify the Customer—except in cases of force majeure— via email sent to the user with the owner or administrator profile so that they are fully informed of such circumstances; under no circumstances shall this entitle the Customer to hold TuriTop liable.
TuriTop shall not be liable for (i) any losses not attributable to a breach on its part, (ii) business losses (including loss of profits, revenue, contracts, loss of anticipated savings, data, loss of goodwill, or unnecessary expenses incurred), (iii) any indirect or consequential losses that were not reasonably foreseeable by both parties at the time the purchase of the Products and/or Services was formalized by both parties, or (iv) any system error regarding the price of subscriptions, which TuriTop will notify the Customer of in order to correct it by applying the price corresponding to the subscription chosen by the Customer. (v) any financial, operational, or administrative losses that the Customer or its customers may suffer due to loss of access to the platform in the event of a material breach in the use of the platform in accordance with Section 7 of these terms and conditions.
In the event that applicable Spanish law undergoes any modification regarding the limits of liability or the exercise of rights by the Customer, the limits legally established following such legislative modification shall apply.
Furthermore, TuriTop shall not be liable for:
- Any delay or failure to fulfill its obligations under these terms and conditions, if such delay or failure is attributable to circumstances beyond TuriTop’s reasonable control.
- The availability, accessibility, continuity, and/or operation of the website.
- The use that Customers make of the existing content or services.
- Links to third parties, if any.
- Content published by Customers through their accounts on the TuriTop booking system.
- Cancellation of the service in compliance with a request from the competent judicial or administrative authorities.
The Customer shall be liable for any damages that TuriTop, other Platform Users, and/or third parties may suffer as a result of the Customer’s failure to comply with the obligations assumed under these Terms and Conditions.
TuriTop strives to provide a secure and efficient platform for receiving payments and issuing invoices. However, it assumes no liability or obligation regarding Customers’ compliance with laws and tax regulations. In this regard, Customers acknowledge that any problem, dispute, penalty, or legal consequence arising from their failure to comply with laws and regulations is their sole responsibility.
Notwithstanding the foregoing, the contracting of services provided by TuriTop implies the necessary acceptance of the following disclaimers of liability:
- Any user who, within the scope of our website and the services provided, acts on behalf of a company or any other legal entity acknowledges that they have sufficient authority to represent it lawfully.
- If an employee contracts services through TuriTop on behalf of their company, TuriTop shall not be liable for any issues arising in the event of resignation, termination, or if, for any reason, the employee ceases to be part of the company. TuriTop is unable to ascertain the specific circumstances of each user or to restrict their access to our services; therefore, it is the company’s responsibility to notify us of any circumstances affecting the foregoing that must be taken into account.
- In line with the previous section, TuriTop shall not be liable in any way for any access, use of the platform, expenses, use of plans, service contracts, or other possible circumstances carried out unlawfully due to circumstances not reliably communicated to TuriTop. If necessary, TuriTop may provide a history of access to and use of the platform to verify that no incidents have occurred.
10. Protection of Personal Data
10.1 Information on Data Processing on the Platform
The Customer declares that they are familiar with and comply with Spanish and European legislation regarding the Protection of Personal Data, and, specifically, with the GDPR, LOPDGDD, and LSSI, and undertakes to respect and comply with such laws throughout the duration of the contractual relationship and when accessing the services provided by TuriTop.
For its part, TuriTop complies with the relevant European and Spanish regulations, specifically, but not limited to:
- Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter, "GDPR")
- Organic Law 3/2018 of December 5 on the Protection of Personal Data and the Guarantee of Digital Rights (hereinafter, "LOPDGDD")
- Law 34/2002 of July 11, on Information Society Services and Electronic Commerce (hereinafter, “LSSI”)
Purposes of Data Processing
TuriTop, S.L., as the data controller, will process the personal data of Customers (users of its services and, where applicable, representatives and employees of legal entities) for the following purposes:
- Manage their registration, process the selected service subscription, provide the contracted service, enable access to the platform, perform the necessary integrations for specific services, and manage billing and payment for their services.
- TuriTop may process data from owner accounts, as well as from suppliers, hotels, and any other type of account created to be independent—or capable of being independent—in order to track their usage, present new services or improvements to those already contracted, make commercial offers, and follow up on them. All of the above is based on legitimate interest, and TuriTop may use for this purpose both the platform itself, contact information (email, phone number, address), and messaging applications such as WhatsApp or Telegram.
- Maintain a record of transactions that allows for their traceability and ensures compliance with current tax regulations or legal liability requirements.
- To compile statistics on platform usage to improve existing features and identify needs and areas for efficiency improvements.
- Store data on the client, its customers and suppliers, and any other information necessary to maintain records for the self-imposed retention periods, as well as those required by law.
- To maintain control over and a log of user access to ensure system security and the traceability of user and privilege management.
Legal Bases for Data Processing
The legal basis for data processing is the performance of a contract, the recording of platform usage statistics and transactions, the logging of accesses, and compliance with voluntary retention periods (Art. 6.1.b, GDPR); compliance with legal obligations regarding minimum retention periods required by current legislation; and the recording of financial or contractual transactions (Art. 6.1.c, GDPR); legitimate interest will apply to the processing of personal data for marketing and advertising purposes, provided that the data collected is professional or corporate in nature; this legal basis will also apply to the collection of platform usage statistics (Art. 6.1.f); and finally, with regard to data on contact persons, employees, legal representatives, or similar individuals, where data is processed during the development or execution of the contract, such data will be processed for the proper performance of the contract, based on the legitimate interests of the parties, in accordance with Article 19 of LOPD 3/2018.
Disclosure of Data to Third Parties
The personal data of platform users will not be disclosed to third parties, except in cases provided for by law, such as to judges and courts, and public administrations. In the event of agreements between platform users through the marketplace, the data that the parties transmit to one another will be their sole responsibility, and TuriTop shall be exempt from such responsibility.
International Data Transfers
TuriTop is a technology platform that uses services from various providers of management, communications, and storage services, as well as various APIs integrated into its platform. Many of these service providers have their headquarters in the United States; therefore, the data processing carried out on the platform may involve international data transfers covered by the European Commission’s decision approving the Transatlantic Agreement.
Rights of Data Subjects
TuriTop guarantees the exercise of the rights of access, rectification, erasure, objection, restriction, data portability, and the right not to be subject to automated decision-making, including profiling; users affected by the application of legitimate interests, provided that their contact information includes personal data, may object to the processing of their data at any time.
These rights may be exercised by writing to the mailing address indicated in these Terms and Conditions, by emailing ayuda@turitop.com, or by contacting TuriTop’s Data Protection Officer at dpo@turitop.com. Requests to exercise these rights will be resolved within a period not exceeding thirty days. To exercise these rights, the data subject may request specific forms from TuriTop; they may also download the forms made available by the AEPD on its website, www.aepd.es. If a User believes that their rights have not been respected, they may file a complaint with the Spanish Data Protection Agency.
10.2 Data Protection Agreement or Data Processing Agreement
TuriTop, as the owner of the platform, stores information on its servers regarding CLIENTS, their users, and their end customers, including data collected in the vendor-type accounts created by the CLIENT. In accordance with current data protection legislation, this designates TuriTop as a data processor.
In this regard, TuriTop provides its clients with a data protection agreement that governs compliance and liability for both parties, particularly TuriTop, ensuring full compliance with the regulations in force at all times. This document can be found during the platform registration process, during the contract signing process, and in your user dashboard. /data-processing/
The Customer must enter into data processing agreements with its Provider Users and with any other service provider to whom it grants access to the platform as an external user.
11. Termination or Expiration of the Contract
The contract between the parties may be terminated at any time for the following reasons:
- Upon expiration of the trial period without the Customer proceeding to subscribe to a plan.
- By mutual agreement between the parties, or withdrawal or renunciation by one of them.
- Voluntary cancellation of the subscription or suspension of payment by the Customer in accordance with Section 11.1.
- Material breach of the contract by either party of any of the obligations set forth therein, in particular due to nonpayment or late payment by the Customer.
- Expiration of the contract term or the period for the provision of services.
- For specific reasons set forth, if applicable, in the special terms and conditions applicable to the Customer.
- Due to supervening impossibility of providing the service.
- Due to death, declaration of death, dissolution, or termination of either party.
- Due to the concurrence of any other causes that, in accordance with applicable Spanish law, could result in such termination and/or rescission.
- The Customer exhibits inappropriate, aggressive, or unseemly attitudes or behavior, or expresses disrespect toward TuriTop employees verbally or in writing, as set forth in Section 7.e.
In cases of nonpayment, in addition to the amounts owed, TuriTop may claim from the Customer any applicable interest and expenses resulting from such nonpayment. Likewise, where applicable, TuriTop may claim from the Customer payment for any damages it may have incurred.
Termination of the Contract between the parties entails not only the definitive and immediate suspension of the Service but also the automatic return by the Customer to TuriTop—or to the entity or entities specifically designated by TuriTop for this purpose—and, in any case, within a maximum period of forty-eight (48) business hours, the return of the computer equipment, goods, and other items associated with the Service that the Customer has in its possession and that it received from TuriTop as part of the Service, in the same condition in which they were received by the Customer.
The grounds for termination or rescission set forth in these terms and conditions shall apply automatically, without the need for further notice or additional request to the Customer by TuriTop.
11.1 Subscription Management · Voluntary Cancellation or Modification of Contracted Plans and Services
The Customer may cancel their subscription, pause payments, or modify their plan and any aspect related to their subscription at any time, at no additional cost, except on the first day of each calendar month (cutoff date), on which requests of this type will not be processed, as it coincides with the close of the transaction fee calculation period. Requests will take effect starting with the next billing period.
To do so, the Customer may use the self-service options available in the control panel, under: Company › Billing Information › Cancel Account (guide). TuriTop will process the request within a maximum of 72 hours, at which point the cancellation will take effect. Cancellation of the account by the Customer will result in the restriction or termination of access to the Platform; the Customer may continue to use the Platform until the end of the period for which payment has already been made. Once that period has elapsed, access to the Platform’s features will be suspended, but the account and data will be retained in accordance with the provisions of Section 11.2.
11.2 Availability of Data Upon Termination of the Contract
Unless expressly requested by the Customer, TuriTop will keep the Customer’s account data available and accessible to the Customer for a period of one year. The customer will have access to this data in a commonly used and interoperable format so that they can download it at any time.
Once this period has expired, only administrative and management data will be retained until the statute of limitations for legal liability has expired.
In the data processing agreement, you can find more information about the retention of personal data hosted on the platform when TuriTop acts as a data processor. Questions regarding data processing can be sent to dpo@turitop.com.
12. Use of Applications and Integration with Artificial Intelligence APIs
12.1 Improving TuriTop’s Efficiency, Performance, and Management
TuriTop has integrated an artificial intelligence system into its administrative and customer service operations to manage inquiries and provide support to customers and users. The tools selected for this purpose have been chosen in accordance with current data protection regulations and by implementing a wide range of technical and organizational security measures.
TuriTop will always inform the user when they are interacting with a bot. It is important for the user to keep in mind that communication with the bot is not the same as communication with a human; rather, it is an automated system designed to assist. While it can provide useful responses, its assistance has limitations and does not replace human support when necessary; TuriTop makes such support available to users through the channels listed in Section 6 of these terms.
Likewise, we inform you that TuriTop is undergoing continuous improvement, and should any significant changes, modifications, or new features involving artificial intelligence be implemented, TuriTop will duly notify its customers.
13. TuriTop MarketPlace: Resellers, Providers, and Hotels
13.1 The TuriTop Platform as a Technological Tool
Our platform acts solely as a technological tool to facilitate connections between experience providers and resellers of their services.
The legal contractual relationship is established solely and exclusively between the experience provider and the reseller. All sales, prices, availability, and terms and conditions related to these experiences are established and agreed upon directly between these parties.
TuriTop does not typically intervene in negotiations between the parties and therefore bears no responsibility for the agreements they reach. In such cases, TuriTop does not participate in, validate, or enforce any agreement, nor do we guarantee compliance with any obligation assumed by either party.
Resellers are fully responsible for ensuring that their activities comply with all applicable laws and regulations, including, but not limited to, consumer protection laws, tax laws, and privacy laws.
In this regard, the CUSTOMER acknowledges and agrees that TuriTop is not liable for any dispute, loss, cancellation, or damage that may arise from such transactions between third parties.
13.2 Large-Scale Distribution Campaigns Promoted by TuriTop
On certain occasions, TuriTop may enter into distribution agreements with platforms that have a wide reach, from which its experience provider clients may benefit. When this occurs, the agreement regarding the terms of distribution services, as well as the provision of specific content developed by TuriTop (product landing pages, etc.), among other matters, will initially be formalized by TuriTop with the distributor, and the supplier clients will subsequently be informed of the agreement so they may opt in if they so desire.
In these cases, TuriTop acts as a mediator regarding the agreement, providing technical resources and clear, transparent information to the supplier client. Payments and compliance with the obligations of both the distributor and the supplier shall be the responsibility of both parties, and TuriTop shall not be liable for any disputes, losses, cancellations, or any damages or loss of profits incurred by the distributor or supplier.
